What we do
Experts in Labour and Social Security Law: from Advisory to Litigation
Our main areas of intervention
Corporate Litigation Defence
We provide comprehensive legal assistance to companies in all phases of employment litigation, whether ordinary, precautionary, or urgent. Our work covers disputes relating to employment relationships from their establishment to termination. We represent companies in proceedings challenging individual and collective dismissals, even in complex scenarios, as well as in claims for recognition of higher duties or wage differentials. We also provide qualified defence in disciplinary proceedings and related appeals, and in disputes with social security (INPS) and insurance (INAIL) institutions regarding employment classification, proper qualification of employment relationships, and calculation of the contributory base.
Judicial Protection of Employees and Executives
We provide qualified assistance and defence to employees, middle managers, and executives in disputes arising during or after the employment relationship. Our litigation work focuses on challenging dismissals, whether for disciplinary reasons or objective grounds. We assist executives in actions for recognition of executive status or higher duties, and in disputes over remuneration components such as bonuses, MBO, stock option plans, and non-compete indemnities. A specific area of expertise concerns defending executives in civil or criminal proceedings for acts performed in the exercise of their functions.
Tailored Advisory to Employees and Executives
We provide personalised legal advice to employees, middle managers, and executives at all strategic stages of their careers. Our services include support in the negotiation and drafting of employment contracts, with particular attention to remuneration packages (including MBO, stock options, and other incentives), non-compete agreements, and stability clauses (“golden parachutes”). We analyse rights and obligations under the employment relationship, interpreting relevant provisions of national collective agreements (CCNL), for example regarding legal protection in case of litigation. We advise on the scope of delegations of authority and liability, helping to prevent and mitigate personal risks. Finally, we assist in negotiating settlement agreements for consensual termination, addressing related tax and social security issues, such as the application of additional taxation on bonuses and stock options.
Strategic Advisory to Companies
We provide ongoing legal consultancy to support companies in the ordinary and extraordinary management of personnel. Our non-contentious services include drafting and negotiating employment contracts (for workers, employees, middle managers, and executives) and independent contractor agreements, drafting non-compete clauses, stability agreements, and company policies. We assist with every phase of the employment relationship: recruitment, disciplinary procedures, and termination. Our expertise extends to advice on contractual frameworks, managing industrial relations and negotiations with trade unions, and supporting corporate reorganisations impacting personnel (e.g. business transfers, collective redundancies). We also issue legal opinions and provide assistance with social security and insurance compliance, proper application of national collective bargaining agreements (CCNL), and inspections by supervisory authorities.
Advisory to Self-Employed Professionals and Agents
We offer highly specialised legal assistance to self-employed professionals and commercial agents, categories characterised by complex and evolving legal frameworks. Our objective is to provide comprehensive support throughout the relationship, from its establishment to termination, including social security aspects and dispute management.
Sector-Specific Support for Other Professionals
• Support for Non-Employment Lawyers We provide strategic and operational advice to colleagues managing cases with significant employment law implications. Our assistance includes case analysis, drafting legal opinions (pareri pro veritate), preparing complex pleadings, and support in hearings or negotiations. We also advise on the employment aspects of corporate transactions (mergers, acquisitions, business transfers), ensuring a comprehensive assessment of personnel-related risks and liabilities.
• Support for Labour Consultants We collaborate with labour consultants in managing issues beyond routine compliance, particularly those involving complex legal matters. Our assistance covers pre-litigation and litigation, interpretation of complex contractual or statutory provisions, management of disciplinary procedures, support during inspections, and negotiation of settlement or second-level collective agreements. We may also act as technical consultants in court proceedings.
